These Terms & Conditions ("Terms") govern the access to and use of the website, platform, services, applications, tools, scanners, software, and related features provided under the SIZED brand ("SIZED", the "Services").
The Services are operated by Treedy's SA, a Belgian company having its registered office at Avenue Louise 251, 1000 Brussels, Belgium, registered under company number BE 0635.598.339 ("Treedy's", "we", "us", or "our").
By accessing or using the SIZED website or Services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Services.

These Terms apply to the use of the SIZED website and to all current and future SIZED services, including but not limited to:
Specific B2B agreements, commercial proposals, subscription agreements, service contracts or scanner leasing agreements may contain additional or different terms. In case of conflict between these Terms and a signed commercial agreement, the signed commercial agreement shall prevail for the services covered by that agreement.
Where a customer subscribes to a SIZED plan, add-on or paid service through a signed commercial agreement, order form, quotation or service contract, the specific terms of that document shall apply in addition to these Terms. In case of conflict, the signed commercial agreement shall prevail for the relevant paid services.
SIZED provides technology solutions designed to help companies improve sizing, fitting, body measurement collection, and garment recommendation processes.
The Services may include, depending on the product or plan selected:
SIZED may rely on a combination of proprietary technologies, algorithms, scanner data, user-provided information, partner data, product data, brand data, retailer data, scraping-based data collection and other technical sources to provide its Services.
The Services are intended for professional and business use.
You must be at least 18 years old to use the Services. By using the Services, you confirm that you are at least 18 years old and that you have the legal capacity and authority to accept these Terms on your own behalf or on behalf of the company or organisation you represent.
If you use the Services on behalf of a company, you confirm that you are authorised to bind that company to these Terms.
SIZED may allow the creation of company accounts. These accounts may enable companies to invite employees, collaborators or other authorised individuals to create a profile linked to the same company account.
Users are responsible for ensuring that all information provided through the Services is accurate, complete, up to date and lawful.
The company account holder is responsible for managing access rights, invitations and use of the Services by its authorised users.
Users may be able to delete their account or request deletion of their account, subject to technical, contractual, legal or compliance limitations.

You are responsible for any consequences resulting from inaccurate information, incorrect use of the Services, failure to follow instructions, or unauthorised use of your account.
SIZED may provide body measurements, size advice, fit recommendations and related outputs based on body scans, manual measurements, product data, size guide data, tech-pack data, brand data, retailer data or other information.
SIZED aims to provide accurate and useful recommendations. However, size and fit recommendations depend on several factors, including but not limited to:
For these reasons, SIZED does not guarantee a perfect fit in all cases.
The accuracy of measurements and recommendations may depend on strict compliance with the scan instructions provided by SIZED.
Users must follow all applicable instructions, including but not limited to clothing requirements, posture, positioning, environmental conditions and technical requirements.
Scanner-based measurements may be affected by improper installation or unsuitable environmental conditions, including but not limited to:
SIZED shall not be responsible for inaccurate results caused by failure to comply with scan procedures, dress code requirements, installation requirements or usage instructions.
SIZED may use data provided by brands, retailers, manufacturers, partners, users or third-party sources. SIZED may also collect or process publicly available product or size-related data through automated tools, where permitted.
SIZED is not responsible for inaccuracies, omissions, outdated information or inconsistencies in data provided by third parties, including but not limited to size guides, tech-packs, garment specifications, product descriptions, product dimensions, fabric characteristics, fitting indications or production information.
Where recommendations depend on third-party data, the accuracy of the recommendation may be affected by the quality and reliability of that data.
SIZED may offer several pricing plans, subscription models, paid services and optional add-ons. The applicable pricing, scope of services, usage limits, contract duration and payment terms will be displayed on the website, communicated in a commercial offer, or agreed in a separate contract.
The SIZED pricing plans may include, without limitation:
The content, features, limits and prices of each plan may evolve over time. The pricing and conditions applicable to a customer are those displayed at the time of subscription, stated in a commercial offer, or agreed in a signed contract.
SIZED may offer annual billing options. Where available, annual plans may include commercial benefits such as two months free and a 10% discount on additional scans.
Annual billing benefits, discounts and conditions may change over time and may be subject to eligibility, plan type, contract duration or specific commercial terms.
SIZED may offer optional add-ons in addition to the selected pricing plan. These add-ons may include, without limitation:
The availability, content and pricing of add-ons may depend on the selected plan, technical feasibility, the number of scanners, the data available, the contract terms and the customer's configuration.
Unless otherwise agreed in writing, access to paid Services may be conditional upon payment of the applicable fees.
Payment methods may be provided through third-party payment processors or other payment solutions. The available payment methods may change over time.
If a payment method is not yet available or not yet defined, SIZED may provide payment instructions separately, including by invoice, bank transfer, online payment link or another accepted payment method.
SIZED may update its pricing plans, add-ons, features, usage limits or commercial conditions for future subscriptions, renewals, new contracts or new services.
Pricing changes will not affect an existing signed contract during its agreed contractual term, unless otherwise provided in that contract.
Unless otherwise expressly agreed in writing or required by applicable law, setup fees, monthly fees, subscription fees, add-on fees, additional scan fees and other paid Services are non-refundable.
Unless expressly stated otherwise, prices are exclusive of VAT, taxes, duties or other applicable charges. Any applicable taxes will be added where required by law.
The SIZED website may allow companies to request a demo, contact the SIZED team, submit business information, request a quote or discuss a potential commercial collaboration.
Submitting a form, requesting a demo, using the savings simulator, exchanging emails or participating in commercial discussions does not create a binding contract between SIZED and the requesting company.
Any commercial relationship, deployment, scanner usage, subscription, integration, leasing, service package or paid engagement may be subject to a separate written agreement.
The Services may contain links to third-party websites, platforms, retailers, brands or external services. Future SIZED applications may also include affiliate links or redirects to third-party retailers.
SIZED is not responsible for:
When users access third-party websites or services, they do so at their own risk and subject to the terms and policies of those third parties.
The current SIZED website does not display advertising.
Future consumer-facing applications or services may include advertising, affiliate links, sponsored content, promotional messages or other monetisation features. Any such features may be subject to additional terms, privacy notices or user choices where required by law.
All intellectual property rights relating to SIZED, the Services, the website, the software, the technologies, the algorithms, the databases, the designs, the user interfaces, the trademarks, the logos, the text, the visuals, the documentation and any related materials are owned by Treedy's SA or its licensors.
The SIZED brand is owned by Treedy's SA.
No rights are granted to users except for the limited right to access and use the Services in accordance with these Terms and any applicable agreement.
Users may not copy, reproduce, modify, distribute, sell, license, reverse engineer, decompile, extract, reuse, display publicly or otherwise exploit any part of the Services, website, content, logo, technology or software without prior written authorisation from SIZED.
Screenshots, logos, visuals, texts and other SIZED materials may not be reused without prior written permission.

SIZED reserves the right to suspend or restrict access to the Services in case of suspected misuse, breach of these Terms, security risk or unlawful activity.
SIZED aims to provide reliable and useful Services. However, the Services are provided on an "as is" and "as available" basis.
SIZED may update, improve, modify, suspend, replace or discontinue certain features or Services when necessary, including for maintenance, technical updates, service improvement, product evolution, security, compliance, commercial reasons or where a service is no longer used by customers.
SIZED is not responsible for temporary unavailability, technical errors, bugs, maintenance periods, updates or interruptions, except where liability cannot be excluded under applicable law.
To the fullest extent permitted by applicable law, SIZED shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, loss of revenue, loss of business opportunity, loss of data, loss of goodwill or business interruption.

The use of the Services may involve the processing of personal data. SIZED processes personal data in accordance with applicable data protection laws, including where applicable the General Data Protection Regulation.

SIZED may suspend, restrict or terminate access to the Services where:
Users may stop using the Services at any time and may request account deletion where applicable, subject to legal, contractual, technical or compliance requirements.
SIZED may update these Terms from time to time to reflect changes in the Services, legal requirements, business practices or technical developments.
The updated version will be made available on the website. The "Last updated" date will indicate the latest version.
Continued use of the Services after the publication of updated Terms constitutes acceptance of the updated Terms.
These Terms are governed by Belgian law.
In the event of a dispute, the parties agree to first attempt to resolve the matter amicably.
If no amicable resolution can be reached, the courts of Brussels, Belgium, shall have jurisdiction. The language of proceedings shall be French, unless otherwise required by applicable law or agreed between the parties.
